Donald Trump has decided to shrug off the last vestiges of pretense and go full authoritarian—denying laws that require the IRS to turn over his tax forms, launching a lawsuit to prevent Congress from seeing his financial documents, and ordering a former White House staffer to ignore a subpoena on a matter of national security. Trump is deliberately bringing on a collision with Congress that's been avoided for 230 years—and the wreckage threatens to include the entire government. That picture of Andrew Jackson that Trump keeps on his wall isn’t just there because it allows Trump to bask in the history of racism and cruelty. Jackson is also there for his most famous response to a court decision that he didn’t like: “John Marshall has made his decision; now let him enforce it!" With Trump gleefully defying every law he faces, and Attorney General William Barr standing by to administer absolution for all sins, just what action can be taken? The direct order from Trump to block the testimony of former White House personnel security director Carl Kline is likely to be the first of Trump’s beyond-unitary-executive claims to get a further test. House Oversight Committee Chairman Elijah Cummings has already announced his intention to hold a vote on a motion of contempt directed at Kline. And he has pulled no punches in describing where things stand: “The White House and Mr. Kline now stand in open defiance of a duly authorized congressional subpoena with no assertion of any privilege of any kind by President Trump.”  Rep. Cummings states that Trump “believes that the Constitution does not apply to his White House” and that he can order his staff to do anything, legal or not. And he cites an astounding point: Since Democrats took control of the House, the Trump White House has not produced a single official to testify or turned over “a single scrap of paper.” This is an existential fight for the Constitution of the United States, and the battle is already well underway.

As Democrats grapple with the fallout from release of the redacted Mueller report, House Speaker Nancy Pelosi appears to have staked out a position right in between Democratic lawmakers who wish to launch an impeachment inquiry immediately and those cautioning against the political costs of such an endeavor. It's a subtle shift from her effectively taking impeachment «off the table» because it's too divisive, to let's make the case to the American people through a fact-finding mission and see where we land. That's not likely to please the liberal wing of the Democratic party at present, but Pelosi's post-Mueller evolution on the topic seems to be driven less by politics than by duty to country and the realization that Democrats don't have the luxury of getting this wrong.  “We have to save our democracy,« Pelosi told fellow Democrats late Monday during a 90-minute phone call concerning impeachment. »This isn’t about Democrats or Republicans. It’s about saving our democracy,” she added. Some Democratic lawmakers made an impassioned push for opening impeachment proceedings during the call. Rep. Val Demings of Florida, who spent 25 years in law enforcement, argued that the evidence against Trump had reached the threshold for opening an inquiry. “While I understand we need to see the full report and all supporting documents, I believe we have enough evidence now,” Demings said, according to the Washington Post. But the caucus also undertook a discussion of how much the politics of impeachment should guide their decision on the matter, with some members arguing that whether you like it or not, «It is political.» Following the call, California Democratic Rep. Ro Khanna told MSNBC that Pelosi had downplayed the political considerations of the topic. When one member asked about polling on impeachment, «Nancy Pelosi cut him off,» Khanna recalled, paraphrasing the speaker as saying, «'Look, this is not going to be a political decision. We've been called by history—this is a duty, we need to make the case.'» And to Pelosi, Democrats can make that case without calling it impeachment, per se, or as she put in a letter to her colleagues Monday, «the facts regarding holding the President accountable can be gained outside of impeachment hearings.»

The leader of a militia group responsible for kidnapping and holding hostage hundreds of migrants at the border claimed to have been training to assassinate President Barack Obama and Hillary Clinton. Court documents unsealed on Monday claim that the FBI went to Larry Mitchell Hopkins’s home in New Mexico when witnesses had passed on those statements as well as reports of seeing militia members with guns at Hopkins's home. Hopkins, aka Johnny Horton Jr., was charged on Monday for being a felon in possession of the firearms found in that 2017 search, which recovered nine weapons as well as ammunition. Hopkins is leader of the United Constitutional Patriots, and has a history of vigilantism. One of the three convictions that banned him from owning guns was criminal impersonation of a «peace officer» in Oregon. Hopkins's lawyer says that the guns aren't Hopkins's and that his arrest and current charges «is not dealing with what is happening down here,» meaning the illegal detention of migrants. The unsealed court documents reveal that witnesses saw as many as 20 militia members «armed with AK-47 rifles and other firearms» at Hopkins's home. The documents say that «Hopkins also allegedly made the statement that the United Constitutional Patriots were training to assassinate George Soros, Hillary Clinton and Barack Obama, because of these individuals' support of Antifa.» Hopkins was «living at the camp near the border fence» according to a spokesman for the group of militiamen posing as border agents. According to spokesman, Hopkins/Horton «didn't have a gun. He didn't bring a gun. Johnny did not bring a gun» and was just a «Vietnam veteran who was cooking meals for people at the camp.» A «victim» who was just feeding those impersonating law enforcement officers and «helping to enforce the laws of America on immigration.»

Campaign Action After reportedly saying that he was open to officially reinstating large-scale family separation at the southern border, acting Department of Homeland Security Secretary Kevin McAleenan is now telling NBC News that the administration is “not pursuing that approach,” claiming that “the president has been clear that family separation is not on the table.” But there’s a catch, because of course. ”Really a better system, as I've said many times, would allow us to detain families together,” McAleenan continued. As DHS Watch has noted, the administration has floated a “proposed regulation to remove legal prohibitions on indefinite detention of children which would result in a massive increase in indefinite incarceration of families seeking asylum.” “If the proposed regulation is finalized and implemented,” DHS Watch continues, “the result would be incarceration of families seeking asylum as they indefinitely await decisions on their cases in the immigration courts, a process that could take months or even years given the increasing court backlog.” Really, the future of family separation at the southern border probably isn’t in McAleenan’s hands, at least not with White House aide and white supremacist Stephen Miller around. Miller, the architect of the administration’s worst anti-immigrant policies, has outlasted two confirmed DHS secretaries, John Kelly and Kirstjen Nielsen, and was reportedly a driving force behind the ouster of the latter. In this administration, his word has oftentimes been the final word. Only time will tell what happens here, but McAleenan’s words don’t seem to hold much weight, considering that Donald Trump acts impulsively and on a whim, and that he’s often driven not by what department heads suggest to him, but instead by what shadow department head Miller tells him.
