Trump's plan: Declare victory on Mueller no matter what and demand Republicans clap harder

Donald Trump and Republicans are getting ready to claim victory whenever Special Counsel Robert Mueller’s investigation winds down. It would be extremely difficult, if not impossible, for Mueller to indict a sitting president, but Team Trump will spin anything short of an indictment as a win for Trump, proof that he did nothing wrong and that House Democrats should therefore stop investigating. According to the AP, “Trump has told his inner circle that, if the report is underwhelming, he will use Twitter and interviews to gloat over the findings, complain about the probe’s cost and depict the entire investigation as an attempt to obstruct his agenda, according to advisers and confidants.” But that requires neither sources nor a crystal ball—of course it’s what Trump would do. And talk about moving the goalposts! The Mueller investigation has brought charges against six of Trump’s (now-former) associates. His former campaign chair is going to prison. His longtime personal lawyer and fixer pleaded guilty to a whole lot of stuff, directly implicated him in campaign finance violations, and is going to prison. His former deputy campaign manager pleaded guilty to two counts and has cooperated with the investigation. His former national security adviser pleaded guilty on one count and cooperated. It is beyond clear that Russia did indeed work for Trump’s victory. This is not underwhelming! This is corruption on a historic level. Even with Trump’s sustained campaign against Mueller—a campaign Mueller hasn’t bothered to try to counter with anything but solid investigative work and prosecutions—57 percent of Americans say Mueller is interested in finding out the truth, not in hurting Trump politically. (And he’s a registered Republican, so why would that be his goal?) Mueller probably can't indict Trump under existing rules. But if Mueller doesn’t indict Trump, Trump will declare victory. What’s the word? … Rigged, maybe? And that’s one of the many reasons House Democrats do need to keep investigating Trump. That and the fact that it’s their job. And that, as House Intelligence Committee Chair Adam Schiff points out, Mueller’s investigation does not appear to have fully delved into questions about Trump and money laundering. So, yeah. Donald Trump will claim victory. And it’ll be as false as anything else Trump says.

Her proposal for universal child care certainly is a winner. Kamala Harris dropped a bit to land just barely behind her in third place, with Beto O’Rourke not far behind her, definitely getting a boost out of his announcement last week. Buttigieg is the only other person cracking five percent and … does anyone really think he’ll stick around that high? He’s riding the high from a viral appearance at South by Southwest. I’d guess it’s temporary.  My sense is that, broadly speaking, Bernie, with his universal name ID, has little room to grow. Meanwhile, the threats to his candidacy are twofold: 1) Elizabeth Warren matches up ideologically, and can be a source of defections if he falters (or if his more virulent supporters drive people away), and 2) the nonideological part of Bernie’s base, those looking for a fresh new face untainted by the stench of the establishment, are favorably predisposed toward Beto (and Buttigieg could catch sustained fire). Those of you on political Twitter might have noticed that Bernie supporters have an especially pronounced hatred for Beto. Their tactics might be unproductive (hurling invective at detractors wins exactly zero new votes), but they’re not wrong to sense the threat. This poll further suggests that threat is real.

A Mexican immigrant died in Customs and Border Protection (CBP) custody this week, BuzzFeed News reports. This is the fourth death involving CBP since December: The man, who has not been identified, died at Las Palmas Medical Center in El Paso, Texas, after being diagnosed with flulike symptoms, liver failure, and renal failure, US Customs and Border Protection said in a statement. Just over a month ago, another Mexican man died in intensive care after being taken into custody by the agency. “He was found to have cirrhosis of the liver and congestive heart failure, the agency said in a statement,” the New York Times reported. In December, two migrant children, 7-year-old Jakelin Ameí Rosmery Caal Maquin and 8-year-old Felipe Gómez Alonzo, died. Both of their families have said the children were healthy before being taken into custody by CBP. “These tragedies cannot continue to happen,” said Astrid Dominguez of the American Civil Liberties Union. “A transparent and independent investigation into the conditions at CBP detention facilities and its medical care practices is needed immediately. Only significant reforms to the agency and independent oversight can ensure the humane treatment of every person entering this country.”

Donald Trump again tweeted an attack on the husband of one of his top aides Wednesday morning. “George Conway, often referred to as Mr. Kellyanne Conway by those who know him, is VERY jealous of his wife’s success & angry that I, with her help, didn’t give him the job he so desperately wanted,” Trump ranted. “I barely know him but just take a look, a stone cold LOSER & husband from hell!” George Conway has emerged as a public critic of Trump, while Kellyanne Conway’s main role in the White House seems to be shamelessly lying in defense of Trump on television. There’s a lot that’s just fascinating here: George is not just a run-of-the-mill Republican, but one who actively took part in the efforts to take down President Bill Clinton in the 1990s. The Conways first came to Trump’s attention when George successfully argued to keep the Trump name on a building they lived in. The fact that he has become a Trump critic is in itself noteworthy. Then there’s the substance of the tweet. Far from being jealous of his wife’s success—success that is not in any obvious policy or strategic area but, again, seems to consist of staying on Trump’s good side by being willing to defend him on the air no matter what—on election night 2016, the Washington Post reported of George that “Tears streamed down his face, and he shouted to anyone who would listen: ‘She did it! She did it! She made history.’” At Kellyanne’s moment of triumph, George was proud, not jealous. The job that Trump claims not to have given him? When George Conway announced in June 2017 that he was withdrawing himself from contention for a Justice Department job, he said that “I am profoundly grateful to the President and to the Attorney General for selecting me to serve in the Department of Justice”—and there was no “he wasn’t offered the job” pushback from the White House, even though he hadn’t been formally nominated. Instead, George stayed in New York taking care of the couple’s four children and continuing to earn millions of dollars a year as a partner in a top law firm while Kellyanne worked for Trump in Washington, D.C. Again, he looks supportive of her career—just not of the lies her boss tells or his unconstitutional actions. Loser? “Partner at a major law firm making millions of dollars a year, who has won before the Supreme Court” is not usually the kind of resume Donald Trump sneers at. And if George Conway is at this point a husband from hell, it sure seems like it’s because his inability to be silent about Trump came between him and his wife. Conway responded: “You seem determined to prove my point. Good for you!  #NarcissisticPersonalityDisorder”

When California Democrat Adam Schiff took the helm of the House Intelligence Committee, he quickly announced a sweeping investigation focused on Donald Trump's finances. Now it's clear that Schiff's main concern is ascertaining whether Trump is under foreign influence, and he views Trump's finances as the most fertile ground for examining that question. In an interview with NBC News, Schiff maintained that the counterintelligence investigation was far more urgent to national security concerns than the inquiry into Trump’s potential criminality. «What Americans should be concerned about is whether the president's Russia policy is not dictated by our national interest but is dictated by his desire to make hundreds of millions of dollars off a tower in Moscow,» Schiff said. He also noted the limits of indictments in terms of revealing whether someone is compromised by a foreign power. In fact, NBC reports, most counterintelligence probes don't end with indictments because criminality is difficult to prove, and the information involved is often too sensitive to make public. Public officials found to be compromised often leave their posts quietly rather than being brought into the spotlight. Georgetown University Law Center Professor Martin Lederman agreed with Schiff, arguing that what's motivating Trump's actions in office is far more critical than any criminality that may have taken place during the campaign. «It's more important to know what Trump is NOW than to know what he did in 2016,» Lederman observed. Schiff is concerned that the question of foreign influence on Trump through his finances may not have been fully explored by Mueller, if at all. «From what we can see either publicly or otherwise, it's very much an open question whether this is something the special counsel has looked at,» Schiff said. He added that the red line Trump drew at Mueller examining his personal finances is «not a line that can be observed and still protect the country.»
