Senators are letting themselves off the hook with sexual harassment bill, women's rights groups say

Sexual harassment in Congress is a scandal—and it would probably be a lot more of one if Congress hadn’t written its own rules for dealing with allegations in secret. But since the #MeToo movement has shined a light on sexual harassment, the House of Representatives has managed to pass a decent bill. The Senate … hasn’t, and the bill it has coming up for a vote is not the answer. The American Civil Liberties Union, Equal Pay Today, the Leadership Conference on Civil and Human Rights, National Women’s Law Center, and Public Citizen are calling on the Senate to strengthen its bill.  Their letter points to serious weaknesses in the Senate bill, including that it doesn’t call for an independent investigator, instead putting approval of settlements in the hands of the ethics committees of both the House and the Senate to sign off on if the settlement is because of a member of Congress’s own actions: “This provision appears to provide an opportunity for a Member who has settled a claim to avoid personal accountability and to be absolved from reimbursing the taxpayers,” the groups wrote in the letter. Additionally, the Senate bill fails to hold members liable for discrimination settlements: “A Member who has committed wrongdoing should be liable for all damages negotiated in a settlement or awarded by a court; they should not be shielded from the consequences of their actions,” they wrote. Seriously. Time for Congress to be held accountable—and the way for that to happen is for Congress to write its own rules to demand accountability.

Live Like We’re Dying: Last week in this space, I talked about a “nuclear option” that Virginia Senate Democratic leadership might use this week to force a floor vote on expanding Medicaid through the state’s budget. Yeah, the finger’s still hovering over the launch button. On Tuesday, the state Senate reconvened in Richmond so Republicans could drag their feet some more over expanding healthcare access to over 300,000 Virginians, basically. Despite the fact that a key Republican on the budget-writing Senate Finance Committee had worked out a Medicaid expansion provision with his GOP counterpart in the state House (which has already voted to expand Medicaid), Senate Majority Leader Tommy Norment demanded that senators come back again next week to debate and—hopefully—vote on the final budget. Democratic Senate Leader Dick Saslaw backed off—temporarily—of his threat to force the budget to the floor for a vote via an extraordinarily rare discharge motion. He’s vowed to pull the discharge maneuver next week if GOP leadership remains obstinate. … and by GOP leadership, I mostly mean Norment, whose frustration with his (likely) inevitable legislative defeat (he’s ardently opposed Medicaid expansion from the get-go) revealed itself as he ranted on the Senate floor about rumors that he’d retire if he lost this battle. He swore to “be here in 2019 and 2020 to kick your ass.” Okay! Tune in next week, same Bat-time, same Bat-channel, to see if Virginia has a Medicaid-expanding budget yet!

The Wall Street Journal has reviewed emails revealing that Donald Trump’s longtime ally and former campaign adviser Roger Stone personally sought out dirt on Hillary Clinton from WikiLeaks founder Julian Assange through an intermediary. In a Sept. 18, 2016, message, Mr. Stone urged an acquaintance who knew Mr. Assange to ask the WikiLeaks founder for emails related to Mrs. Clinton’s alleged role in disrupting a purported Libyan peace deal in 2011 when she was secretary of state, referring to her by her initials. “Please ask Assange for any State or HRC e-mail from August 10 to August 30--particularly on August 20, 2011,” Mr. Stone wrote to Randy Credico, a New York radio personality who had interviewed Mr. Assange several weeks earlier. Credico wrote back suggesting that whatever information WikiLeaks had was likely already posted to the site, but Stone was persistent. “Why do we assume WikiLeaks has released everything they have ???” Stone replied. In another email, Mr. Credico then asked Mr. Stone to give him a “little bit of time,” saying he thought Mr. Assange might appear on his radio show the next day. A few hours later, Mr. Credico wrote: “That batch probably coming out in the next drop...I can’t ask them favors every other day .I asked one of his lawyers...they have major legal headaches riggt now..relax.” Collusion. It's not even a matter of eagerly accepting «dirt» from a hostile foreign agent à la Don Jr., it's a matter of seeking it out. Stone had claimed in testimony to the House Intelligence Committee that he “merely wanted confirmation” that Assange had dirt on Clinton. Internal documents reveal physical and sexual abuse of migrant kids, teens by Border Patrol

Internal government documents dating back to 2009 and obtained through the Freedom of Information Act (FOIA) by American Civil Liberties Union (ACLU) and International Human Rights Clinic at the University of Chicago School of Law, detail horror stories of child abuse, physical and sexual assault, verbal abuse and medical negligence at the hands of Customs and Border Protection (CBP) agents. The details should be a national security concern, because border agents were already “monstrous” under Barack Obama, and under Donald Trump they have been unleashed and stand to endanger untold numbers: In one complaint we obtained, a Border Patrol agent grabbed a girl he claimed was running away, handcuffed her to someone else and dragged them together along the ground, causing “two bruises on her neck, scratches to her shoulders and arms, and thorns in her head.” A 16-year-old recounted that a Border Patrol agent threw him down before he used his boot to smash his head into the ground. Other children allege that agents assaulted them with their feet, fists, flashlights, and Tasers. In one case, an agent ran over a 17-year-old with a patrol vehicle and then got out and punched the child in the head and body. Often, children noted that other agents witnessed the abuse or saw the injuries but refused them medical attention. In one case, agents accused a pregnant minor of lying about the pain — which turned out to be labor contractions preceding a stillbirth. The records, from the Office for Civil Rights and Civil Liberties, a DHS oversight agency, “show that the leadership at Customs and Border Protection were well aware of the allegations of unlawful child abuse—including people still now directing the agency—yet there is no indication that any individual official was ever held accountable for abuse,” the ACLU continues. Yet, this could be just a sliver of the abuse at the hands of government officials—the ACLU has yet to issue a report on the rest of the 30,000 documents spreading over three other agencies, including Immigration and Customs Enforcement (ICE).

 Jose “Ivan” Nuñez, arrested in Philadelphia by Immigration and Customs Enforcement (ICE) during an routine interview with U.S. Citizenship and Immigration Services (USCIS), is now approaching his fifth month of detention. Nuñez, an undocumented immigrant originally from Mexico, had gone to the January 31 interview as part of a process to gain legal status through his U.S. citizen husband, Paul Frame. It was supposed to be a routine interview. “It was anything but routine”: Since Jan. 31, Ivan has been locked up by ICE at a prison facility in York, Pennsylvania. He has been given no opportunity to explain to an immigration judge why his confinement is unnecessary. Ivan doesn't understand why ICE is imprisoning him. Neither does Paul or anyone else who knows Ivan. “In the meantime,” the American Civil Liberties Union (ACLU) reports, “detention is taking a heavy toll. Ivan has been losing weight, losing sleep, at times fearing for his safety in ICE custody. Paul has been suffering, too,” worrying about what could happen to his husband in detention—and what could happen to him if he’s torn from him and deported. “He thought he would be safer here in the U.S.,” said the ACLU of Pennsylvania’s Reggie Shuford. “His detention is cruel and unjust, and it discourages people who have a legal path to staying here from pursuing it.” According to research, “the horrific abuse that LGBTQ immigrants face in detention facilities is well-documented. According to the Bureau of Justice Statistics, nonheterosexual people are more than twice as likely as the general population to be sexually assaulted while in confinement”: From 2009 to 2013, 1 in 5 substantiated allegations of sexual assault in ICE detention facilities had a transgender victim. In addition to sexual assault, LGBTQ people in detention face verbal and physical abuse; prolonged solitary confinement; and the withholding of critical health care needs, such as hormone therapy or HIV medication.
